Husband Seeks Dissolution Marriage Due To Wife's HIV Status Being Positive

In this story  the question arises will a wife remain with her husband if he is HIV positive?

A 38 year old civil servant,Silas Dodo has requested that the Upper Area Court in Maraba,Nassarawa State,dissolve his marriage with his wife due to her HIV status  being positive,even though he is still HIV negative. 

The News Agency of Nigeria  reported that Dodo,told the court on Tuesday that he wanted to divorce the wife ,35 ,that he married in 2007.

Dodo told the court that the wife was found to be HIV positive following a recent test they had.

He further went on to tell the court that he met his wife in 2002 The Federal University of Technology,Yola and they were married in 2007 in a church.

He said that before they were married both of them were screened on the church's directive  and they were both HIV negative at the time.

He stated that, no too long after his marriage ,his sexual relationship with his wife deteriorated as she started denying him sex.

The complainant said his wife was always falling sick ,a condition that compelled him to take her to the several clinics to have some tests done and she was found to be HIV positive

Do said that when he discovered his wife's HIV status ,he instructed his lawyer to write to his wife and the church.The wife later packed out of their matrimonial home in Masaka and went to live on her own at Auta Balafi.

In her response the woman ,who was not represented by a counsel ,admitted that the HIV test results tendered by her husband were genuine.

Counsel to the complainant ,Mr Elisha Onaji ,therefore urged the court to adjourn the case to another date .
The presiding officer,Mr Vincent Gwahemba adjourned the matter till March,31.2014 for continuation.
